VAS authorises you to upload materials to the sub-site created for your organisation within the Shetland Community Portal.
If you fail to keep your access password confidential for any reason VAS will not be liable for any loss claim or damage arising as a result of that omission and VAS reserves the right at all times to withdraw your access to services.
You are prohibited from posting or transmitting to or from this site any unlawful, threatening, libellous, defamatory, obscene, pornographic, or other material that would violate any law.

User Chatrooms:

VAS may, but is not obligated to, monitor or review any areas on the Shetland Community Portal where users transmit or post communications or communicate solely with each other, including but not limited to chat rooms, bulletin boards or other user forums, and the content of any such communications. VAS, however, will have no liability related to the content of any such communications, whether or not arising under the laws of copyright, libel, privacy, obscenity, or otherwise.

If you create links within your sub-site to third party web sites, these must be viewed in new browser windows.

It is your responsibility to ensure that you own the copyright to any material published on your sub-site or have obtained the prior permission of the copyright owner to any material uploaded to your sub-site. VAS may at its discretion require you to provide evidence of copyright or owners permission to use copyright material to any material uploaded to your sub-site within the Shetland Community Portal. In the event of a breach of copyright by you in your sub-site the Limitation of Liability stated above will apply.

The Shetland Community Portal Rules:

You agree to use the Shetland Community Portal (including Message Boards) in accordance with the following Rules.

About your upload of materials to your sub-site:

  • Materials must be civil and tasteful
  • No disruptive, offensive or abusive material is allowed.
  • Unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable.
  • You are prohibited from displaying third party advertising material on your sub-site

Posts to any discussion forum or guestbook:

You must monitor contributions to your discussion forum to ensure that they conform to the following rules:

  • Contributions must be civil and tasteful
  • No disruptive, offensive or abusive behaviour: contributions must be constructive and polite, not mean-spirited or contributed with the intention of causing trouble.
  • No unlawful or objectionable content: unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable.
  • Any contributions which do not conform to acceptable standards must be removed promptly by you.

Email Facility:

You are prohibited from using the bulk email facility for spamming.
It is your responsibility to ensure that any personal information obtained by you via your sub-site is gathered and maintained within the rules of the Data Protection Act 1998

If you breach these Terms of Use:

If you fail to abide by these conditions when using the Shetland Community Portal facilities to publish your sub-site, you will be sent an e-mail which informs you why you have breached these conditions. This e-mail will also include a warning that continuing to breach the rules may result in action being taken against you and/or your organisation. This action may include a temporary or permanent suspension of your ability to participate in any or all of the Shetland Community Portal website facilities.
VAS reserves the right to delete any content, on any sub-site, at any time, for any reason.

Applicable Laws:

VAS makes no representation that materials at this site are appropriate or available for use outside the United Kingdom, and access to them from territories where their contents are illegal is prohibited. You may not use or export or re-export the materials at this site or any copy or adaptation in violation of any applicable laws or regulations including without limitation UK export laws and regulations. If you choose to access this site from outside the UK, you do so on your own initiative and are responsible for compliance with applicable local laws. These terms will be governed by and construed in accordance with Scottish law, without giving effect to any principles of conflicts of laws.
